Terms of Service

1. Who we are and what these Terms cover

These Terms of Service (the “Terms”) form a binding agreement between you and Wild Creative Interactive, 3081 Ontario Street East, Montréal, Québec H1W 1N7, Canada (“we”, “us”), the operator of the game Little Monsters Realm, the website littlemonstersgame.com and related services (together, the “Service”).

By creating an account, entering a Monster Key or using the Service, you confirm that you have read and accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.

2. Eligibility and age

3. Closed Alpha and Monster Keys

4. Your account

5. License to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and play the Service for your own non-commercial entertainment. The Service, including its software, code, art, characters, monsters, names, music, sounds, text, maps and all related intellectual property, belongs to us or our licensors and is protected by law. Except for this license, no rights are transferred to you.

You may share screenshots, videos and streams of your own gameplay, including for monetized personal content, provided you do not suggest that we endorse you, you do not share content we have expressly asked to keep confidential, and you do not use our trademarks or art in a way that could confuse people. We may withdraw this permission for specific content.

6. Virtual items and in-game currency

7. Rules of conduct

To keep the realm fun and fair, you agree not to:

8. Content you create

You keep your rights to content you create and submit through the Service (for example names, messages or builds). You grant us a worldwide, royalty-free, non-exclusive license to host, store, display, reproduce and adapt that content as needed to operate, promote and improve the Service. You confirm that you have the rights to what you submit and that it complies with these Terms. We may remove any content at our discretion.

9. Feedback

If you send us ideas, suggestions or bug reports, you allow us to use them freely, without obligation or compensation to you, and we may incorporate them into the Service. This does not transfer your moral rights where the law does not allow it.

10. Moderation, suspension and termination

11. Availability and changes

We work hard to keep the Service online but do not guarantee that it will be uninterrupted, secure or error-free, or that any content, feature or data will remain available. We may update, change or discontinue all or part of the Service.

12. Disclaimer

To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms excludes or limits the legal warranties and rights that cannot be excluded under the law that applies to you, including, for consumers in Québec, the Consumer Protection Act and the Civil Code of Québec.

13. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of data, progress or virtual items, arising from your use of or inability to use the Service, and our total liability to you for any claim relating to the Service during the free Alpha is limited to CAD $50. These limits do not apply to liability that cannot be limited by law, including liability for bodily or moral injury, for intentional or gross fault, or where the law of your residence gives consumers greater protection.

14. Indemnity

To the extent permitted by law, you agree to indemnify us against claims by third parties resulting from your breach of these Terms or your misuse of the Service. This section does not apply to consumers where the law prohibits it.

15. Governing law and disputes

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there. Subject to the mandatory rights you have as a consumer, the courts of the judicial district of Montréal, Québec, have jurisdiction. If you are a consumer residing elsewhere, you keep the protection of the mandatory laws and courts of your place of residence. Nothing in these Terms requires you to use arbitration or waives your right to take part in a class action where the law protects that right.

Before any legal step, please contact us: most issues can be solved quickly and informally.

16. Changes to these Terms

We may update these Terms, for example when the game evolves or at launch. We will post the new version with its effective date and, for significant changes, notify you in the game or by email at least 30 days in advance where the law requires it. If you do not agree to the new Terms, you may stop using the Service and close your account; continuing to use it after the effective date means you accept them.

17. Language

These Terms are available in French and in English. The parties have expressly requested that they be drawn up in both languages. For users in Québec, the French version prevails in case of discrepancy.

18. General

If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of the Service, provided your rights are not reduced. These Terms, with the Privacy Policy, are the entire agreement between you and us about the Service.
